These Terms & Conditions (“Terms”) govern your participation in the MOVA Membership Points Program (“Program”) operated by Spacewalker Technology USA Inc. (“MOVA,” “we,” “us,” or “our”). By registering for the Program, you agree to be bound by these Terms. If you do not agree, please do not participate in the Program.

IMPORTANT NOTICE: We value your experience and encourage the prompt and informal resolution of any concerns. Accordingly, Section 14 contains important provisions regarding dispute resolution, including a requirement to attempt informal resolution before filing a claim, limitations on class and representative proceedings, waiver of jury trial rights, applicable governing law, venue, and time limits for bringing claims. By participating in the Program, you agree to these dispute resolution procedures. Please read Section 14 carefully.

1. Eligibility

The MOVA Membership Points Program is open only to individual customers who:

          Are legal residents of the United States (including the District of Columbia);

          Are at least 18 years old (or the age of majority in your state of residence);

          Register with a valid personal email address.

The Program is not available to businesses, resellers, wholesalers, automated systems, or any third-party purchasing for commercial purposes. We reserve the right to verify eligibility and to deny,  suspend or terminate participation at our sole but reasonable discretion where we reasonably believe a user does not meet eligibility requirements or has violated these Terms.

MOVA may rely on account data, transaction history, and reasonable verification procedures to assess eligibility and enforce these Terms.

2. Program Registration

          Participation is free and requires creating an account on our website via the “JOIN NOW” button.

          Only one account per person is permitted. Duplicate accounts may be closed and all accumulated points forfeited.

          By registering, you consent to the collection, use and processing of your personal data as described in our [Privacy Policy] and agree that your participation in the Program is subject to and governed by our Website [Terms & Conditions] [1] and these Terms.

3. Earning MOVA Membership Points

You can earn MOVA Membership Points (“Points”) through the following activities.
Points are credited to your account after the applicable activity is validated.

Placing an order on our website 5 Points per $1 USD spent 
Registering a new account 2,000 Points (one time)
Leaving a product review on our website (honest review, positive or negative) 2,000 Points per approved review
Each Product can only receive one time points reward.
Sharing our Membership Page on Facebook (valid share) 300 Points
You can share multiple times but only receive the reward for 1st time.
Adding or updating your birthday in your account 500 Points per calendar year (birthday gift)
Exchanging Forum Points (from MOVA Forum) 100 Forum Points = 1 MOVA Membership Point (one‑way, irreversible exchange; automatically synced)


Additional earning rules:

          Order Points are calculated on the net purchase price (after discounts, before taxes and shipping). Points are credited after payment is completed and the order is shipped.

          Points from reviews, sharing, birthday, and registration are awarded after the action is verified by MOVA. MOVA may reject fraudulent or duplicate submissions.

          Third-party purchases (e.g., from Amazon, eBay, or retail stores) do not earn Points – only purchases made directly on the official MOVA US website qualify.

          Bonus Points (e.g., promotional offers) will be clearly communicated at the time of the promotion and are subject to the same validity period, unless otherwise specified in separate promotional rules.

          Important Notice: Certain activities in this Program (such as product reviews or social media sharing) may be incentivized with Points. If you receive Points for posting content, please clearly disclose this incentive where required by applicable law (for example, by using hashtags such as #Incentivized).

4. Redeeming Points

Points can be redeemed in your account’s Rewards section. The following redemption options are available:

Cash Discount 100 Points = $1 USD discount on a future purchase (applied at checkout).
Member‑only Rewards Exclusive accessories available only to MOVA North American members (selection may change).
Coupons Discount coupons for accessories, vacuum cleaners, and other eligible categories. Coupon values and requirements are shown in the Rewards section.
Products Selected accessories, hot products, or best‑value items – availability and point prices vary and are subject to change.

Redemption restrictions:

          Points cannot be exchanged for cash except where required by applicable law (e.g., certain states may require a cash‑out option for small balances – MOVA will comply with such laws).

          Points cannot be used to pay for taxes, shipping fees.

          Coupons redeemed with Points may not be combined with any other discount codes, promotions, or offers unless explicitly stated otherwise by MOVA.

          Coupons are generally valid for a limited time (see coupon details). They may be restricted to specific categories or products.

          Redemption of Products is subject to stock availability. MOVA may modify the catalogue of redeemable products at any time without prior notice.

5. Point Expiration

          Points are valid for 12 months from the date they are earned.

          MOVA reserves the right to modify the validity period of Points in accordance with applicable law and will provide notice where legally required.

          Expired Points will be automatically removed from your account and cannot be reinstated unless required by applicable law (e.g., some states may have different rules for loyalty program points – MOVA will comply with state legal requirements).

          The expiration date of Points can be viewed in your account’s Points history.

6. Transfers of Points

          Points are non‑transferable as a general rule. They cannot be sold, traded, bartered, or combined with another person’s account.

          Exception: If you are unable to log into your account or your registered email is no longer in use, you may request a transfer by emailing support@mova-tech.com with proof of account ownership (e.g., past order details, ID). MOVA may, at its sole discretion, approve a transfer after reasonable verification.

          If approved, Points from your old account will be transferred to your new account, and the old account’s Points will be cleared. Transfers are processed within a reasonable time.

7. Withdrawal from the Program

          Participation is voluntary. You may withdraw at any time by:

        Deleting your account; or

        Contacting us at support@mova-tech.com to request removal from the Program.

          Withdrawal from the Program will not affect any rights or obligations accrued prior to the withdrawal date, including but not limited to pending transactions, returns, refunds, or Points adjustments.

          Upon withdrawal, any unredeemed Points will be forfeited and cannot be redeemed, except where prohibited by applicable law.

          Withdrawal does not entitle users to any cash compensation for unused Points.

          Where required by applicable law, MOVA will honor outstanding Points balances or provide alternative remedies to the extent legally required.

8. Returns and Refunds

The following rules apply when you return a product purchased on our website:

You earned Points from that order (including bonus Points) Those Points will be deducted from your account.
You used Points to pay (partially or fully) for that order The Points you redeemed will be returned to your account.
You earned Points that were already redeemed for a coupon/product and cannot be reversed MOVA may, where permitted by law, adjust your refund amount to reflect the value of those Points (currently $1 per 100 Points).

 

9. Points Adjustment and Negative Balance

If your account has a **negative Points balance** after a return, cancellation, or any adjustment (for example, because you used Points that were later reversed), MOVA may take one or more of the following actions, to the extent permitted by applicable law:

- Points earned will be automatically applied to offset and reduce the negative balance;[2] [3] 

- Temporarily suspend your ability to redeem Points until the negative balance is corrected;

- Deduct or offset the negative balance from any future refunds, store credits, or other amounts owed to you;

- Cancel any pending orders or redemptions that rely on improperly obtained Points;

- Suspend your MOVA account and, in cases involving abuse of the Program or other material violations of these Terms, permanently close your account.

Any offset or deduction relating to a negative Points balance will be calculated based on the value of the applicable Points at the time they were redeemed, as reflected in MOVA's records.

Any repayment or deduction described above will be applied only where permitted under applicable law and subject to any mandatory consumer protection requirements.

MOVA will apply corrective actions in a reasonable and proportionate manner, taking into account the nature and severity of the adjustment or misuse.

10. Account Security and Prohibited Conduct

          You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

          You agree to provide accurate, current and complete information and to update it promptly.

          Prohibited conduct includes, but is not limited to:

        Creating multiple accounts to earn extra Points;

        Using bots, scripts, or automated methods to generate Points (e.g., fake shares, fake reviews);

        Abusing the referral or birthday systems;

        Attempting to sell or exchange Points for money outside the Program;

        Any fraudulent, abusive or manipulative behaviour that undermines the integrity of the Program.

If we detect or reasonably suspect any violation of these Terms, we may, at our reasonable discretion, and without prior notice or liability to you:

          Cancel or revoke Points already earned;

          Suspend or terminate your participation in the Program;

          Close your account and prohibit future registration.

**Exploitation of processing delays is prohibited.**

If we determine that you intentionally canceled an order (or returned a product) before the associated Points were deducted, and then used those same Points for a redemption or purchase, such conduct will be considered abuse of the Program and a material breach of these Terms.

MOVA may reasonably determine, based on system records, transaction history, and audit data, whether an activity constitutes abuse, manipulation, or improper use of Points.

In addition to the remedies above, MOVA reserves the right to treat the improperly redeemed Points as amounts recoverable from you to the extent permitted by law, and to refuse future service.

Any recovery or adjustment actions taken by MOVA will be limited to the extent permitted by applicable law and will not affect your statutory consumer rights.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

          MOVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of Points, profits, data, or goodwill arising from or in connection with your participation in the Program.

          MOVA is not responsible for system failures, technical issues, server downtime, force majeure events (e.g., natural disasters, strikes, internet outages), or any third‑party actions that may affect the earning, tracking, or redemption of Points.

Some states do not allow the exclusion of certain warranties or limitations of liability for certain damages, so the above may not apply to you fully. In those cases, MOVA’s liability is limited to the fullest extent permitted by law of such jurisdictions.

12. Privacy

We collect and process your personal data (such as name, email, purchase history, and birthday) to administer the Program, award Points, provide Program benefits and communicate Program updates. Our data handling practices are described in our [Privacy Policy] and are subject to applicable privacy and data protection laws.

By participating in the Program, you acknowledge that your personal information will be processed in accordance with our Privacy Policy.

13. Amendments and Termination

          MOVA reserves the right to modify, suspend, or terminate the Program (or any part of these Terms) at any time,  subject to applicable law. Any changes will become effective as of the “Last Updated” date stated in the revised Terms. Where required by applicable law, we will provide reasonable advance notice, including by email, through your account, or by posting a notice on our website.

          Your continued participation in the Program after the effective date of the changes constitutes your acceptance of the revised Terms, to the extent permitted by applicable law.

          Upon termination of the Program by MOVA, any unredeemed Points may be cancelled or forfeited, unless prohibited by law.

          Termination or modification of the Program does not create any entitlement to compensation for unused Points unless required by law.

14. GOVERNING LAW AND DISPUTE RESOLUTION

14.1 Governing Law

These Terms and your participation in the Program shall be governed by and construed in accordance with the laws of the State of Delaware and applicable United States federal law, without regard to its conflict of laws principles.

14.2 Informal resolution

Before filing any claim, you agree to first contact us at support@mova-tech.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days. This informal dispute resolution process is intended to facilitate resolution and, to the fullest extent permitted by applicable law, shall be a condition precedent to commencing any legal proceeding.

14.3 Small Claims Court

Subject to the informal dispute resolution process set forth in Section 14.2, either party may bring an individual action in a small claims court of competent jurisdiction, provided that the claim qualifies, meets all legal requirements of such court, remains within its jurisdictional limits, and proceeds solely on an individual, non-class, and non-representative basis.

14.4 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MOVA AGREE THAT ANY DISPUTE SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING.

14.5 Jury Trial Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND MOVA KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE PROGRAM.

14.6 Exclusive Jurisdiction and Venue

EXCEPT FOR CLAIMS PROPERLY BROUGHT IN SMALL CLAIMS COURT AND EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, ANY LEGAL ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE PROGRAM SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN DELAWARE. YOU AND MOVA CONSENT TO THE PERSONAL JURISDICTION AND VENUE OF SUCH COURTS AND WAIVE ANY OBJECTION BASED ON LACK OF PERSONAL JURISDICTION, IMPROPER VENUE, OR FORUM NON CONVENIENS, TO THE FULLEST EXTENT PERMITTED BY LAW.

14.7 Time Limitation for Claims

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PROGRAM MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE; OTHERWISE, SUCH CLAIM SHALL BE PERMANENTLY BARRED.

14.8 Severability and Consumer Rights

If any provision of this Section 14 is found unenforceable, the remaining provisions shall remain in full force and effect. Nothing in this Section 14 limits any mandatory statutory rights or remedies that cannot be waived under applicable consumer protection laws.

15. Miscellaneous

Points do not constitute property, currency, or any form of financial instrument, and have no cash value, except where required by applicable law.

MOVAs records, including system logs, transaction data, and account history, shall constitute the primary and controlling evidence for determining Points balances, accrual, redemption, and any adjustments, except in cases of manifest error.

MOVA reserves the right, to the extent permitted by applicable law, to audit, adjust, suspend, or revoke Points in cases of error, fraud, abuse, or system malfunction. Any such actions shall be carried out based on MOVAs system records and in a reasonable, proportionate, and good faith manner, in compliance with applicable law.

If any provision of these Terms is held by a court or competent authority to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permissible to reflect the original intent of the parties, and if not possible, shall be deemed severed from these Terms. The remaining provisions shall remain in full force and effect.

No failure or delay by MOVA in exercising any right, remedy, or provision under these Terms shall constitute a waiver of such right or any other rights. Any waiver must be in writing to be effective.
